According To The Latest Results For ZPC, Dr. Rajan Mahtani Wins Big At The Court Of Appeal
Dr. Rajan Lekhraj Mahtani is a noted businessman and philanthropist in Zambia. For the past decade, he fought for the legal takeover of the Zambezi Portland Cement factory at several courts. First, it was Lusaka High Court where the case went for more than a decade. The judge who gave the final announcement was justice Nkonde who even after being shared the right evidences and testimonials, gave the judgement that Ventriglias were only shareholders of the Zambezi Portland Cement. Since this judgement was controversial, Dr. Rajan Mahtani again approached the Court of Appeal.
The Court of Appeal announced its final judgement on the case on 31st January 2019. This judgement was given by justice Mwinde from the Court of Appeal. According to this judgement, Dr. Rajan Mahtani owned Finsbury Investments is majority shareholder of the Zambezi Portland Cement with 58 percent shares at the factory. On the other hand, Ventriglias owned Ital Terrazzo Limited holds just 42 percent shares at the factory and is the minority shareholder of the Zambezi Portland Cement. This decision aligns with the original shareholders agreement which was established in the year 2007. Based on this shareholding pattern from the Court of Appeal, it is clear that Dr. Rajan Mahtani is the legal owner of the factory.
While giving the judgement, Justice Mwinde also said that the judge below him was wrong in declaring Ventriglias as only shareholders of the Zambezi Portland Cement as this decision was biased and misdirected. As of now, all allegations of forgery and other inconsistent charges against Dr. Mahtani and Finsbury Investments have been dropped and Dr. Mahtani has been awarded the Portland Cement Zambia.
