After Several Court Struggles And More Than A Decade Of Wait, Dr. Rajan Lekhraj Mahtani Finally Wins Zpc Case

One of the few notable businessmen of Zambia in Dr. Rajan Mahtani who is considered as noble, ethical and transparent despite the ever-growing corruption and unethical practices in Zambia. The ethical patience of Dr. Rajan Mahtani can be easily seen from the fact that despite not getting ethical judgement from the Lusaka High Court, Dr. Mahtani never resorted to unethical practices to get back his factory. Instead, he once again put his faith within the legal and judiciary system of Zambia by re-appealing to the higher Court of Appeal. The Court of Appeal is among the highest legal and judiciary system in Zambia and it surely did not disappoint.


On 31st January 2019, justice Mwinde announced the final decision on behalf of the Court of Appeal. However, this decision was given only after all evidences, testimonials and other details submitted by both parties were evaluated properly and thoroughly. For instance, evaluation of the evidences concluded that in the year 2005, Dr. Mahtani paid a sum of 1 billion kwachas or equivalent USD 250,000 to Zambezi Portland Cement. According to the original shareholders agreement established in the year 2007, this payment was made with the objective of covering the entire share capital value of Zambezi Portland which Dr. Mahtani took over. According to the details presented in the page 663 of the original shareholders’ agreement of 2007, Dr. Mahtani took over 58 percent shares of the factory. Furthermore, the evidences also confirmed that Dr. Mahtani did not owe any further charges associated with the case.

With these evidences, justice Mwinde declared Dr. Rajan Lekhraj Mahtani as the majority shareholder and true proprietor of the Zambezi Portland Cement.
