Justice Finally Served To Dr. Mahtani With Historic Court Win For Zambezi Portland Cement Case

The corporate environment of Zambia is well aware of the notorious Zambezi Portland Cement case. The case went from courts to court and from judges to judges, without getting justice. The first court was Lusaka High Court where Dr. Mahtani registered his case with the hope of quick and easy win. However, he was received with disappointment when even after a decade of case being dragged at the court, justice was not served. Then came the Court of Appeal where the case was re-registered again and the hopes were high as the Court of Appeal is among the highest judiciary systems in Zambia. This time, justice was served quick and fast and in a transparent manner. This was possible only due to the fact the justice Mwinde on behalf of the Court of Appeal evaluated all documents, evidences and testimonials submitted and only after that provided his final decision on the case.



The first major document was the contract with all details of the financial transaction which occurred in the year 2005 between Dr. Mahtani and the Zambezi Portland Cement. In this financial transaction, 1 billion kwachas were transferred from Dr. Rajan Mahtani owned Finsbury Investments to the Zambezi Portland Cement and this amount covered the share capital value which Dr. Rajan Mahtani owns of Zambezi Portland. Furthermore, details of this transactions were also found in the original agreement between shareholders curated in 2007. This document also detailed the fact that Dr. Mahtani is not liable to any more charges or taxes.

Based on the above details, justice Mwinde finally announced that Dr. Mahtani is majority shareholder and legal owner of the Portland Cement Zambia factory.
