Dr. Rajan Mahtani’s wait is finally over, higher Court of Appeal announces case results



For honest and ethical businessman like Dr. Rajan Mahtani, the case of Zambezi Portland Cement has been one of the most difficult cases in his business career. Dr. Mahtani faces major roadblocks majority due to the shortcomings associated with the legal system of Zambia. First it was Lusaka High Court which failed to provide justice for the Portland Cement Zambia case and Dr. Rajan Mahtani despite the numerous critical evidences and testimonials shared. Despite being called as extremely controversial decision, the judge at the Lusaka High Court did not change his decision which prompted Dr. Mahtani to approach a higher court, which was higher Court of Appeal.

The judge at Higher Court of Appeal, justice Mwinde, looked into the evidences, testimonials and other factual documents and gave the final decision on 31st January 2019. This time period was in sharp contrast with the decade gap by Lusaka High Court, indicating that justice and transparency is still prevailing within the legal and judicial system of Zambia. The judge from the Court of Appeal shared several details on the evidences which ultimately resulted in the quick and transparent decision. The first major evidence shared to the media & public was the financial transaction worth 1 billion kwachas between Dr. Mahtani and the Zambezi Portland Cement for taking over majority share capital of the factory. The second major evidence was the original shareholders agreement established in the year 2007 in which page number 663 clearly established the fact that Dr. Mahtani took over 58 percent shares at the factory and thus, became the majority shareholder and legal owner of the factory.
