Lusaka High Court Misses Critical Details On Portland Cement, Gives Unfair Judgement



It has been more than a year since the final decision came from higher Court of Appeal on the Zambezi Portland Cement. And it has been almost two years since the Lusaka High Court gave a controversial decision on the Portland Cement Zambia case, shaking the entire nation. Both decisions provide significant aspects to ponder upon. The case of Lusaka High Court clearly indicates the widespread corruption and unethical practices within the Zambia legal system. The long pendency of the case and despite sharing critical evidences, inability of the judge to give a concrete decision is a clear indication that corruption has penetrated even the lawmakers of the nation. It was heartening to see one of the most transparent and ethical businessmen of Zambia, Dr. Rajan Lekhraj Mahtani, struggle as a result of these unethical practices within the nation. On the other hand, the bright side of this struggle was the identification of few selected lawmen who can still be considered as transparent and ethical. Justice Mwinde on behalf of the higher Court of Appeal gave a judgement which was ethical and at the same time justified the evidences and testimonials shared by Dr. Rajan Mahtani. 

Some of the details identified included transfer of one billion kwachas from Dr. Rajan Mahtani owned Finsbury Investments to Zambezi Portland Cement limited which covered the entire share capital value of the Zambezi Portland shares. Another evidence was the shareholders agreement clearly indicating transfer of 58 percent shares of Zambezi Portland to Finsbury Investments. 

While the Lusaka High Court failed to provide judgement, it was justice Mwinde from Court of Appeal who saved the day for Dr. Rajan Mahtani.
