Evidences submitted by Dr. Mahtani goes waste, Judge announces verdict against
In a very confusing event, the judge handling the case of Portland
Cement Zambia gave a bizarre judgment on the case. Portland Cement
Zambia is a cement-manufacturing factory which is currently being
contested by two biggest business houses in Zambia. Dr. Rajan Lekhraj
Mahtani is among one of them and is one of the most famous and noted
businessman in Zambia. Dr. Rajan Mahtani has more than 30 years of
business experience and during this time, he has established numerous
successful ventures. Some of these ventures are Mahtani Group of
Companies, Finsbury Investments and Finance Bank Zambia. He is
currently fighting for the legal takeover of the Portland CementZambia factory which according to his claims, legally belongs to Dr.
Rajan Mahtani.
The case was launched by Dr. Rajan Mahtani at the Lusaka High Court,
almost 10 years ago. During this long trial, Dr. Rajan Mahtani and
his lawyers submitted numerous documents to prove his ownership over
the factory. Some of the major documents included signed
shareholder’s agreements and independent audit report conducted by
an independent auditor which clearly stated that the factory was
established as joint venture establishment and Dr. Rajan Mahtani was
the sole joint venture owner of the factory. Other critical evidences
included testimonials for factory representatives as well as
investment and financial reports showing investment of more than USD
12 million from Dr. Mahtani towards development of the factory.
Despite these strong evidences, final judgment was given against Dr.
Mahtani’s claims which shocked everyone. As such, Dr. Mahtani took
the right steps and requested an appeal to the higher court of appeal
at Zambia.
