Foul-play Claimed By Dr. Rajan Mahtani After Final Verdict On Portland Cement
Case of Portland
Cement Zambia has become a good and bad example for the Zambian law
and order. On one hand, it has showcased the patience and ethical
business practices of one of the contestants Dr. Rajan Mahtani. On
the other hand, the case has become one of the longest pending trials
in the corporate area which highlights the limitations of Zambian law
to provide speedy reconciliations in corporate court cases.
The case of
Portland Cement Zambia was registered by Dr. Rajan Mahtani after the
factory was illegally captured. The case was registered at the Lusaka
High Court wherein the case has been going on for more than ten
years. During the case trials, Dr. Rajan Mahtani and his lawyers
submitted numerous evidences and documents that were sufficient
enough to prove that Dr. Mahtani is the real owner of this factory.
Some of the critical documents included signed shareholder’s
agreement, financial exhibits, investment reports as well as
independent audit report which clearly stated that the factory was
established as a joint venture partnership ad Dr. Rajan Mahtani is
the sole joint venture partner of the factory.
However, no
evidence or testimony is going to work if the judgment is clouded and
influenced by external factors. The same happened with the judgment
overlooking the case at the Lusaka High Court. The final judgment was
announced against Dr. Mahtani’s claims and while it was shocking to
say the least, it was clear that the judgment was misdirected. As
such, Dr. Rajan Mahtani has taken the right steps and registered an
appeal at the higher court of appeal.
