Portland Cement Zambia Case Winner Announced By Higher Court Of Appeal Judge


Dr. Rajan Mahtani is one of the most successful businessmen in Zambia. Dr. Rajan Mahtani is also known for taking businesses to new heights, whether these businesses are started from scratch or are taken under his wing after initial failures. Under his leadership, Portland Cement Zambia factory became one of the biggest producers of Portland Cement within the province. Apart from achieving this feat, Dr. Rajan Mahtani transformed the factory into one of the best manufacturing employers in Zambia with above industry-average wages and salaries, transparent promotional and career progression opportunities as well as appropriate work-life balance.



However, this success was short-lived with the factory being unethically and illegally taken over. After this, Dr. Rajan Mahtani registered a case at the Lusaka High Court and numerous proceedings took place. It took the Lusaka High Court almost a decade to announce the final decision on the case and this decision was extremely misdirected. As a result, Dr. Rajan Lekhraj Mahtani re-appealed to the higher Court of Appeal with all evidences and testimonials. The judge at the higher Court of Appeal was justice Mwinde and after looking into all evidences and testimonials, announced that Dr. Mahtani was the majority shareholder of the factory. This conclusion was made based on transfer of one billion kwachas from Finsbury Investments to Portland Cement Zambia factory. Justice Mwinde also concluded that Dr. Rajan Mahtani, after giving one billion kwachas or USD 250,000 to the Portland Cement Zambia, took over 58 percent shares of the factory. This was confirmed with the original agreement between shareholders established in the year 2007. Based on all these evidences, it was finally announced that Dr. Rajan Mahtani is indeed the actual owner of the factory.
